Thank you for choosing Lotara, your personal wellness companion. These Terms of Service govern your use of the Lotara mobile application and related services provided by Lotara LLC By downloading, accessing, or using Lotara, you agree to be bound by these Terms. If you don't agree to these Terms, please don't use our app.

1. About Lotara

Lotara is a wellness journaling application designed to help you track your daily wellness journey through journaling, build healthy habits with personalized reminders, monitor your progress with analytics, access meditation and mindfulness content, and integrate with health data from Apple HealthKit when you choose to do so.

2. Eligibility and account requirements

To use Lotara, you must be at least 13 years old. By using Lotara, you confirm that you meet this age requirement. Lotara may not be available in all countries or regions. You must comply with all applicable local laws and regulations.

3. Your account

When you create an account with Lotara, you must provide accurate, complete, and current information during registration. You are responsible for maintaining the security of your account and all activity on your account.

Choose a strong, unique password and keep it confidential. Never share your login credentials with others, and notify us immediately if you suspect unauthorized access.

4. Your content

When you create journal entries, habits, or other content in Lotara, you retain full ownership of that content. You grant us a limited license to store and process your content to provide our services and create aggregated, anonymized analytics.

Your content must not violate any laws or regulations, infringe on others' intellectual property rights, or contain harmful, threatening, or offensive material.

5. Subscription services and premium features

Lotara offers a free tier and premium subscription options.

Access essential wellness features at no cost, including:

• Basic habit tracking (limited habits)
• Journal entries with basic templates
• Meditation library access
• HealthKit integration
• Cloud sync across devices

Premium subscriptions

Monthly Premium ($2.99/month):

Free trial

New users may be eligible for a 7-day free trial of Premium features as displayed at signup. If you don't cancel during the trial, you'll be automatically charged for the subscription. You can cancel anytime during the trial to avoid charges. Free trials are limited to one per user account.

Subscription terms

All subscriptions automatically renew at the end of each billing period unless canceled at least 24 hours before the current period ends. You will be charged through your Apple App Store account. Taxes may apply based on your location. We may change subscription prices with 30 days advance notice.

Cancellation

To cancel your subscription, use your App Store account settings, not the Lotara app. Cancel at least 24 hours before your next billing date. Cancellation takes effect at the end of your current billing period, and you retain premium access until then.

Refunds

All refund requests must be made through the Apple App Store, as we cannot process refunds directly. Refunds are subject to App Store policies. For technical issues, contact our support team before requesting a refund.

6. Health data and disclaimers

Lotara's wellness insights and analytics are generated by algorithms and should not be interpreted as clinical assessments or substitutes for professional medical advice.

HealthKit integration is completely optional. You control what health data you share with us, and we only access data you specifically authorize.

7. Privacy and data protection

Your privacy is fundamental to us. Our Privacy Policy explains how we collect, use, and protect your information. By using Lotara, you also agree to our Privacy Policy.

For users in the European Economic Area, you may contact our Data Protection Officer at admin@lotara.app for GDPR-related inquiries.

8. Intellectual property

Lotara and all related trademarks, logos, and content are owned by us or our licensors. You may not copy, modify, or distribute our intellectual property without permission. All rights not expressly granted to you in these Terms are reserved by Lotara LLC

9. Prohibited conduct

You agree not to:

• Use Lotara for any illegal purpose or in violation of any laws
• Engage in any activity that promotes violence, discrimination, or harm
• Attempt to gain unauthorized access to our systems or networks
• Use automated scripts, bots, or other automated means to access Lotara
• Create multiple accounts or fake accounts
• Upload content that infringes intellectual property rights
• Provide medical advice or diagnosis to other users

10. Service availability

We strive to maintain high service availability but cannot guarantee 100% uptime. We may temporarily suspend services for scheduled maintenance and may modify, add, or remove features at our discretion. Material changes will be announced in-app or via email.

11. Termination

You may terminate your account at any time through the app settings. We may suspend or terminate your account if you violate these Terms. Upon termination, your access to Lotara ends immediately, and we may delete your account data according to our Privacy Policy.

12. Dispute resolution

These Terms are governed by the laws of the United States. Any disputes will be resolved through informal resolution or binding arbitration as mutually agreed upon.

13. Limitation of liability

To the maximum extent permitted by law, we are not liable for indirect, incidental, special, consequential, or punitive damages. Our total liability is limited to the amount you paid us in the 12 months preceding the claim.
